Spanish broadcasters must pay for the cinema

The European Court of Justice has issued a ruling that a payment by broadcasters in Spain of 5% of their turnover for domestic film production is in accordance with European law.


Under the King’s Decree, 60% of the total amount obtained from broadcasters is designated for film production in one of Spain’s official languages.

The decree was challenged by the Private Broadcasters Union, which brought the case before the European Court of Justice. The Court, however, ruled the decree does not constitute public assistance and thus is not in conflict with EU law.
